Le Prophète a dit de ne pas adorer excessivement puisque votre femme a un droit sur vous | The Prophet Said Do Not Worship Excessively As Your Wife Has a Right Over You

`Abdullâh ibn `Amr a rapporté : « Le Messager d’Allah, paix et bénédictions soient sur lui, m’a dit : « Ô `Abdullah, on me dit que tu jeûnes toute la journée et pries toute la nuit. » J’ai dit : "Biensûr, Ô Messager d’Allah." Le Prophète a dit : "Ne fais pas cela. Jeûne et romps ton jeûne, prie la nuit et dors. En vérité, ton corps a sur toi un droit, tes yeux ont sur toi un droit, et ta femme a sur toi un droit." »

Le Prophète de l’Islam; a souligné l’importance du temps avec la famille et du temps à être passé avec sa femme jusqu’au point où il a dit de ne pas se permettre l’adoration de Dieu excessivement au prix de la violation de leurs droits. Lui, paix et bénédictions soient sur lui, il a utilisé le mot « droit ». Les droits sont des choses qui sont données à notre époque par constitution; quelque chose avec quoi nous exerçons notre droit et lorsque celui-ci est violé, nous pouvons même aller à la cour.

Abdullah ibn Amr reported: The Messenger of Allah, peace and blessings be upon him, said to me, “O Abdullah, I am told you fast all day and pray all night.” I said, “Of course, O Messenger of Allah.” The Prophet said, “Do not do so. Fast and break your fast, pray in the night and sleep. Verily, your body has a right over you, your eyes have a right over you, and your wife has a right over you.”

The prophet of Islam; emphasized on the importance of family time and the time to be spent with one's wife to the extent that he said do not indulge in worshipping god excessively at the cost of violating their rights. He peace and blessings be upon him used the word " right" . Rights are something that are given in our times by constitution ; something which we exercise our right with and when violated can even go to the court.

Voici deux incidents où les femmes se sont excusées avec une raison qui en toute honnêteté serait aujourd’hui moquée par les tribunaux et personne ne les croirait, mais quand il s’agit de l’honneur d’une femme musulmane, l’Islam et ceux qui adhèrent à sa loi correctement sont très prudents.

28501 - حَدَّثَنَا أَبُو بَكْرٍ قَالَ: حَدَّثَنَا ابْنُ إِدْرِيسَ، عَنْ شُعْبَةَ، عَنْ عَبْدِ الْمَلِكِ بْنِ مَيْسَرَةَ، عَنِ النَّزَّالِ بْنِ سَبْرَةَ، قَالَ: بَيْنَمَا نَحْنُ بِمِنًى مَعَ عُمَرَ إِذَا امْرَأَةٌ ضَخْمَةٌ عَلَى حِمَارَةٍ تَبْكِي قَدْ كَادَ النَّاسُ أَنْ يَقْتُلُوهَا مِنَ الزِّحَامِ يَقُولُونَ: زَنَيَتْ. فَلَمَّا انْتَهَتْ إِلَى عُمَرَ، قَالَ: «مَا يُبْكِيكَ؟ إِنَّ امْرَأَةً رُبَّمَا اسْتُكْرِهَتْ»، فَقَالَتْ: كُنْتُ امْرَأَةً ثَقِيلَةَ الرَّأْسِ، وَكَانَ اللَّهُ يَرْزُقُنِي مِنْ صَلَاةِ اللَّيْلِ، فَصَلَّيْتُ لَيْلَةً ثُمَّ نِمْتُ، فَوَاللَّهِ مَا أَيْقَظَنِي إِلَّا الرَّجُلُ قَدْ رَكِبَنِي، فَرَأَيْتُ إِلَيْهِ مُقْفِيًا مَا أَدْرِي مَنْ هُوَ مِنْ خَلْقِ اللَّهِ، فَقَالَ عُمَرُ: «لَوْ قُتِلَتْ هَذِهِ خَشِيتُ عَلَى الْأَخْشَبَيْنِ النَّارَ» ثُمَّ كَتَبَ إِلَى الْأَمْصَارِ أَلَّا تُقْتَلَ نَفْسٌ دُونَهُ

Nazzâl ibn Sabrah a dit : « Alors que nous étions à Minâ avec `Umar (RadiAllâhu `Anhu) [là-bas est apparue] une large femme sur un âne, qui était en train de pleurer et a presque été écrasée par la foule de gens autour d’elle, qui disaient : « Tu as commis Zinâ! » Quand elle est enfin arrivée à ‘Umar, il a demandé : « Qu’est-ce qui te fait pleurer? Est-ce que la femme a été forcée (astukrihat)?» Elle a dit : « J’ai toujours été une dormeuse profonde et Allah a rendu facile pour moi de prier la nuit. Pendant que je priais une nuit, je me suis endormie. Par Allah, je ne me suis pas réveillée avant qu’un homme soit monté sur moi! Je l’ai vu par derrière, mais je ne savais pas qui il était parmi les créations d’Allah. »

`Umar a dit : « Si je l’avais exécuté, j’aurais craint l’enfer s’éclater sur les deux montagnes sacrées de Makkah »

28495 - حَدَّثَنَا أَبُو بَكْرٍ قَالَ: حَدَّثَنَا ابْنُ مَهْدِيٍّ، عَنْ سُفْيَانَ، عَنْ قَيْسِ بْنِ مُسْلِمٍ، عَنْ طَارِقِ بْنِ شِهَابٍ: أَنَّ امْرَأَةً زَنَتْ، فَقَالَ عُمَرُ: «أَرَاهَا كَانَتْ تُصَلِّي مِنَ اللَّيْلِ فَخَشَعَتْ فَرَكَعَتْ فَسَجَدَتْ، فَأَتَاهَا غَاوٍ مِنَ الْغُوَاةِ فَتَحَتَّمَهَا»، فَأَرْسَلَ عُمَرُ إِلَيْهَا فَقَالَتْ كَمَا، قَالَ عُمَرُ: فَخَلَّى سَبِيلَهَا "

Târiq ibn Shihâb a dit : « Une femme a commis zinâ (et cette nouvelle a atteint `Umar alors) `Umar a dit : Je pense qu’elle était en train de prier dans [l’obscurité de la] nuit et elle s’est dépassée (c.-à-d. elle s’est rabaissée) pendant qu’elle était en rukû` et sujûd, alors un intrus a fixé son intention (de la violer). Donc, `Umar a envoyé pour elle et elle a dit de même alors `Umar l’a laissé aller et n’a pas infligé de Hadd. »

Il y a d’autres incidents où d’autres grands savants de l’âge d’or de l’ère Islamique ont exécuté de similaires verdicts. Cela démontre que d’une part où le châtiment d’Allah est très strict, de l’autre part il y a beaucoup de règles, d’obstructions et de prudences à prendre en considération avant d’exécuter ces peines sur quelqu’un. En toute honnêteté, personne n’aurait cru à ces excuses aujourd’hui, mais il y a des siècles, à l’époque des chameaux et des ânes, les compagnons du Prophète Muhammad ont cru au témoignage des femmes.

Below are two incidents wherein the women excused themselves with a reason which in all honesty today would be mocked upon by the courts and no one would believe them, but when it comes to the honour of a Muslim woman, Islam and those who adhere to its law properly are very cautious.

28501 - حَدَّثَنَا أَبُو بَكْرٍ قَالَ: حَدَّثَنَا ابْنُ إِدْرِيسَ، عَنْ شُعْبَةَ، عَنْ عَبْدِ الْمَلِكِ بْنِ مَيْسَرَةَ، عَنِ النَّزَّالِ بْنِ سَبْرَةَ، قَالَ: بَيْنَمَا نَحْنُ بِمِنًى مَعَ عُمَرَ إِذَا امْرَأَةٌ ضَخْمَةٌ عَلَى حِمَارَةٍ تَبْكِي قَدْ كَادَ النَّاسُ أَنْ يَقْتُلُوهَا مِنَ الزِّحَامِ يَقُولُونَ: زَنَيَتْ. فَلَمَّا انْتَهَتْ إِلَى عُمَرَ، قَالَ: «مَا يُبْكِيكَ؟ إِنَّ امْرَأَةً رُبَّمَا اسْتُكْرِهَتْ»، فَقَالَتْ: كُنْتُ امْرَأَةً ثَقِيلَةَ الرَّأْسِ، وَكَانَ اللَّهُ يَرْزُقُنِي مِنْ صَلَاةِ اللَّيْلِ، فَصَلَّيْتُ لَيْلَةً ثُمَّ نِمْتُ، فَوَاللَّهِ مَا أَيْقَظَنِي إِلَّا الرَّجُلُ قَدْ رَكِبَنِي، فَرَأَيْتُ إِلَيْهِ مُقْفِيًا مَا أَدْرِي مَنْ هُوَ مِنْ خَلْقِ اللَّهِ، فَقَالَ عُمَرُ: «لَوْ قُتِلَتْ هَذِهِ خَشِيتُ عَلَى الْأَخْشَبَيْنِ النَّارَ» ثُمَّ كَتَبَ إِلَى الْأَمْصَارِ أَلَّا تُقْتَلَ نَفْسٌ دُونَهُ

Nazzal ibn Sabra said : While we were at Mina with `Umar (r.a) [there appeared] a large woman on a donkey, crying and nearly being crushed to death by the throng of people around her, who were saying: “ You have committed zinah “ When she came at last to `Umar , he asked “What makes you weep?, Has the woman, perhaps been coerced (astukrihat)? She said “I have always been a very deep sleeper and Allah has made it easy for me to pray at night. While I was praying one night, I fell asleep. By Allah I did not awaken but that a man had mounted me!. I saw him from behind, but did not know who he was among the creation of Allah.

`Umar said : Had I executed her, I would have feared hell-fire breaking out upon the two sacred mountains of Makkah”

28495 - حَدَّثَنَا أَبُو بَكْرٍ قَالَ: حَدَّثَنَا ابْنُ مَهْدِيٍّ، عَنْ سُفْيَانَ، عَنْ قَيْسِ بْنِ مُسْلِمٍ، عَنْ طَارِقِ بْنِ شِهَابٍ: أَنَّ امْرَأَةً زَنَتْ، فَقَالَ عُمَرُ: «أَرَاهَا كَانَتْ تُصَلِّي مِنَ اللَّيْلِ فَخَشَعَتْ فَرَكَعَتْ فَسَجَدَتْ، فَأَتَاهَا غَاوٍ مِنَ الْغُوَاةِ فَتَحَتَّمَهَا»، فَأَرْسَلَ عُمَرُ إِلَيْهَا فَقَالَتْ كَمَا، قَالَ عُمَرُ: فَخَلَّى سَبِيلَهَا "

Tariq ibn Shihab said : A woman had committed zinah (and this news reached `Umar so) `Umar said : I think that she was praying in the (darkness of the) night and she overcame herself (i.e. humbled herself ) while she was in rukoo` and sujood so a trespasser fixed his intention (to rape) her so `Umar sent for her and she said likewise so `Umar let her go and didn’t inflict any hadd.

There are more incidents where other senior scholars from the golden age of Islamic era have executed similar verdicts . This shows that on one hand where the punishment of Allah is very strict, on the other there are many rules, obstruction and caution to be taken into consideration before executing these punishment upon anyone. In All honesty, no one would have believed these excuses today but centuries ago, during the age of camels and donkeys, the companions of prophet Muhammad believed the women's testimony
