[44] Question : Si une femme est en désaccord avec son mari sur une question de fiqh, comme voyager sans mahram, alors en général, peut-il forcer son avis de fiqh sur elle?
Réponse par Chaykh al-Albani (Rahimahullah) :
« Les hommes ont autorité sur les femmes, en raison des faveurs qu’Allah accorde à ceux-là sur celles-ci. » [Surah An-Nisa’ : 34] Donc, en ce qui concerne cette question, l’avis d’un des époux – soit la femme ou le mari – doit être suivi. Et il n’y a aucun doute que tant qu’Allah, le Puissant et Sublime, a rendu obligatoire pour la femme d’obéir à son mari, son avis n’est pas un facteur décisif. Alors dans cette situation, elle doit l’obéir. Cependant, avant cela, ils doivent céder la parole à l’un et à l’autre et se communiquer entre eux pour tenter de parvenir à un accord entre eux. Mais si (après avoir fait cela) la situation a atteint un point où la question a été posé, alors la réponse (à ce stade) est qu’il est obligatoire pour elle de lui obéir et de ne pas lui opposer. »

[44] Question: If a woman disagrees with her husband over a Fiqh issue, such as travelling without a mahram, then in general, can he force his Fiqh opinion on her?
Answer by Shaykh Albani rahimahullah:
"Men are guardians over women due to what Allaah has favoured some of them over others with." [Surah An-Nisaa: 34] So with regard to the likes of this question, the opinion of one of the spouses – either the wife or the husband – must be carried out. And there is no doubt that so long as Allaah, the Mighty and Sublime, has made it obligatory upon the woman to obey the husband, her opinion is not a decisive factor. So in this situation, she must obey him. However, before that, they must first yield to one another and communicate to try to come to an understanding with one another. But if (after doing this) the situation has reached the point at which the question was asked, then the answer is that (at this point) it is obligatory upon her to obey him and to not oppose him."
