Bonne nouvelle aux étrangers | Glad Tidings to the Strangers

Il a été rapporté sous l'autorité d'Abû Hurayrah que le Messager d'Allâh (ﷺ) a dit :

« L'Islam a commencé comme étant quelque chose d'étrange et il retournera à sa position de départ d'être quelque chose d'étrange. Annoncez donc la bonne nouvelle aux étrangers. »

[Réf : Sahîh Muslim (145), Sunan Ibn Mâjah (3986) et Jami` at-Tirmidhi (2629) où le hadith est rapporté par `Abdullâh Ibn Mas`ûd]

It is narrated on the authority of Abu Huraira that the Messenger of Allah (ﷺ) said:

"Islam initiated as something strange, and it would revert to its (old position) of being strange. So glad tidings for the strangers."

Sheikh `Abdul Qâdir al-Jîlânî (Rahimahullah) a dit :

« Et s'il dit 'Salâm', ne lui répondez pas et apprenez-le que ceci (c.-à-d. dire Salâm) n'est pas une salutation Islamique (et qu'il doit plutôt dire "Assalâmu `Alaykum") »

Sheikh ‘Abdul-Qādir al-Jīlānī (Raḥimahullāh) said: 

“And if he says 'Salām’ do not respond to him and teach him that this (saying Salām) is not an Islamic greeting (rather say Assalāmu'alaikum).”

L'Imâm Mâlik rit des Soufis | Imaam Maalik Laughs at the Sufis

Qâdî `Iyâd a dit à propos de l’Imâm Mâlik sous l’autorité d’al-Tinnisi :

« Nous étions avec Mâlik alors qu’il était entouré de ses compagnons, quand un homme appartenant au peuple de Nasibin dit : "Il y a un groupe de personnes parmi nous appelés Soufis. Ils mangent trop, ensuite ils commencent à chanter, et après ils se lèvent debout et dansent."

Mâlik lui demanda : "Sont-ils des enfants?"

L’homme répondit : "Non. Ils sont un groupe de Mashayikh [des savants religieux] et d’autres gens intelligents."

Mâlik répondit : "Je n’ai jamais entendu parler de quelqu’un parmi les gens de l’Islam faire une telle chose."
L’homme dit : "Mais ces gens mangent, et ensuite se lèvent debout et dansent sans relâche, certains d’entre eux frappant leurs têtes, et d’autres frappant leurs visages."

En entendant cela, Mâlik rit, puis se leva et alla dans sa maison.

Les compagnons de Mâlik dirent à l’homme : "En vérité, tu nous a apporté un mauvais présage à notre compagnon. Nous avons été en sa compagnie pendant plus de trente ans, et nous ne lui avons jamais vu rire avant ce jour." »

Qaadee `Iyaad said about Imaam Maalik on the authority of al-Tinnisi:

"We were with Maalik while he was surrounded by his companions, when a man belonging to the people of Nasibin said, 'There is a group of people among us called Sufis. They eat excessively, then they begin to sing, and then they get up and dance.'

Maalik asked him, 'Are they children?'

The man replied, 'No. They are a group of mashayikh [religious scholars] and other intelligent people.'

Maalik replied, 'I have never heard of anyone from the people of Islam doing such a thing.'

The man said, 'But these people eat, and then get up and dance tirelessly, some of them striking their heads, and some striking their faces.'

Hearing this, Maalik laughed, then rose and went inside his house.

The companions of Maalik said to the man, 'Verily you have brought bad omen to our companion. We have been in his company for more than thirty years, and we never saw him laugh until this day.'"

Une femme a le droit d'être divorcée si son mari est incapable de subvenir à ses besoins | A Woman Has the Right to Be Divorced If Her Husband Is Unable to Spend on Her

L’Imâm Mâlik dans son livre al-Muwatta’ citant le célèbre Tâbi`î, qui a étudié sous de nombreux Sahâbah, Sa`îd Ibn Al-Mussayyab qui a dit : « Si un homme ne trouve pas les moyens de subvenir aux besoins de sa femme, ils doivent être séparés. » L’Imam Malik a dit : « Voilà ce que j’ai vu les gens de science (savants) faire dans notre ville. »

Remarque : Ceci est des bénédictions de cette religion qu’un mariage impose certaines obligations aux mari et femmes. Parmi les obligations qui sont remises au mari est l’obligation de subvenir aux besoins de sa femme, ses besoins de base selon l’époque et le pays et l’endroit où elle vit. Alors, il doit fournir pour elle; de la nourriture acceptable, des vêtements, un abri et des médicaments et autres nécessités de bases. Notez que cela ne signifie en aucun cas qu’il est obligé de l’emmener dans des voyages couteux ou de lui acheter des bijoux, non. Ces choses-là sont volontaires et récompensées mais pas obligatoires pour quelqu’un qui ne peut pas se les permettre avec facilité. L’Islam est juste et modéré. Il n’oblige pas quelque chose au-delà de ses moyens, alors les besoins de base ne comprennent pas le magasinage en fin de semaine, le parachutisme et que sais-je.

 
Ainsi, une femme peut être séparée/divorcée de son mari par le souverain ou le chef s’il voit que le mari est soit bon à rien ou incapable de subvenir à ses besoins. Le souverain peut prendre d’autres mesures comme aider l’homme à trouver une bonne source de revenu ou de lui donner de la charité pour quelques mois jusqu’à ce qu’il soit stable. Tout ceci est des droits des femmes et du bien-être général de la société stipulés pas la loi Islamique.



Allah dit : « Les hommes sont responsables des femmes, en raison des faveurs qu’Allah accorde à ceux-là sur celles-ci, et aussi à cause des dépenses qu’ils font de leurs bien…[Qur’an 4:34]

L’Imâm al-Qurtubî a dit : 

فَهِم العلماء من قوله تعالى: { وَبِمَآ أَنْفَقُواْ مِنْ أَمْوَالِهِمْ } أنه متى عجز عن نفقتها لم يكن قوّاماً عليها، وإذا لم يكن قَوّاماً عليها كان لها فسخ العقد؛ لزوال المقصود الذي شُرع لأجله النكاح. وفيه دلالة واضحةٌ من هذا الوجه على ثبوت فسخ النكاح عند الإعسار بالنفقة والكسوة؛ وهو مذهب مالك والشافعي. وقال أبو حنيفة؛ لا يفسخ؛ لقوله تعالى:
{ وَإِن كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَىٰ مَيْسَرَةٍ }
[البقرة: 280] وقد تقدّم القول في هذا في هذه السورة.



Les savants ont compris du verset « et aussi à cause des dépenses qu’ils font de leurs bien » que si un homme qui incapable de subvenir aux besoins d’elle alors il n’est pas Qawwâm (responsable) d’elle. Et lorsqu’il n’est pas Qawwâm [d’]elle, alors il est permis pour elle de mettre fin au contrat, car l’objectif pour lequel Nikah est prescrit n’est pas rempli. Ce verset est la preuve de la mise à fin du Nikah lorsqu’on est incapable de dépenser sur la maintenance. Ceci est la parole de l’Imâm Mâlik et d’Ash-Shâfi`î, mais l’Imâm Abû Hanîfah a dit : Nikah ne devrait pas être mis à fin car Allah dit : « À celui qui est dans la gêne, accordez un sursis jusqu’à ce qu’il soit dans l’aisance. » [al-Baqarah verset 280]

Imam Malik in His book al-Muwatta quoting the famous taba`ee who has studied under many sahaaba Said ibn al-Musayyab said, "If a man does not find the means to spend on his wife, they are to be separated . " Imam Malik said, "That is what I saw the people of knowledge (scholars) in our city doing"

Note: this is from the blessings of this religion that a marriage enforces certain obligations upon the husband and wives. Among the obligations that are handed over the husband is the obligation to provide for his wife that covers her basic necessities based on the era and land and place she is living in.  So he is to provide for her acceptable food, clothing, shelter and medication and other basic necessities. Note this does not in any way mean that he is obliged to take her on expensive tours, or buy her jewellery no.  These are voluntary and rewarding but not obligatory upon someone who cannot afford it with ease.  Islam is just and moderate. It does not obligate something beyond one's task so basic necessitates do not include weekend shopping, sky diving and what have you.

So a wife can be separated/divorced from his husband by the ruler or the leader if he sees that the husband is either good for nothing or he is unable to spend on her . The ruler may also take other steps such as help the man find a good source of income or give him charity for a few months until he is stable. All of this is from the rights of the women and the overall welfare of the society which Islamic law stipulates.


Allah said: "Men are in charge of women by [right of] what Allah has given one over the other and what they spend [for maintenance] from their wealth..." [Qur'an 4:34 ]

Imam Al Qurtubi al-Andalusi (rahimahullah) said:

فَهِم العلماء من قوله تعالى: { وَبِمَآ أَنْفَقُواْ مِنْ أَمْوَالِهِمْ } أنه متى عجز عن نفقتها لم يكن قوّاماً عليها، وإذا لم يكن قَوّاماً عليها كان لها فسخ العقد؛ لزوال المقصود الذي شُرع لأجله النكاح. وفيه دلالة واضحةٌ من هذا الوجه على ثبوت فسخ النكاح عند الإعسار بالنفقة والكسوة؛ وهو مذهب مالك والشافعي. وقال أبو حنيفة؛ لا يفسخ؛ لقوله تعالى:

The scholars understood from the verse "and what they spend [for maintenance] from their wealth". If a Man who is unable to spend on her then he is not "Qawwam" (In charge) of her. And when he is not "Qawwam" on her then it is allowed for her to terminate the contract, because the aim of marriage is not fulfilled due to which Nikah is prescribed. This verse is the evidence of terminating the nikah when one is unable to spend on maintenance. This is the saying of Imam Malik and ash-Shafiee, but Imam Abu Hanifa said: Nikah should not be terminated because Allah says: "And if someone is in hardship, then [let there be] postponement until [a time of] ease." (al Baqarah verse 280) The tafsir on this verse is already mentioned before .

Tout le monde qui parle n'est pas à être réfuté | Not Everyone Who Speaks Is to Be Refuted

Ibn al-Qayyim (m. 751 AH) a dit :

« En ce qui concerne les partisans ignorants et aveugles, alors ne lui faites aucune attention. Ne vous laissez pas offenser par ses insultes, son excommunication (Takfîr) [de vous] et sa déclaration [que vous êtes] égarés. Certainement, cela est comme l’aboiement d’un chien, alors ne rendez pas le chien important en le répondant à chaque fois qu’il aboie sur vous. Laissez-le dans la joie avec son aboiement.

Et vous, vous-même, réjouissez-vous de la vertu que vous avez reçu par rapport à lui par le biais de la science, la foi (Îmân) et la guidance. Faites de votre détournement de lui une partie de la gratitude pour la bénédiction d’Allâh qu’Il vous a donné et accordé. »

Ibn al-Qayyim (d. 751 AH) said,

"As for the ignorant blind-follower, then do not pay any attention to him. Do not allow his insults to offend you , nor his excommunication (Takfeer) [of you], nor his declaring [you to be] misguided. Certainly, it is like the barking of a dog, so do not make the dog important by responding to it every time it barks at you. Leave it in delight with its barking.

And you, yourself, rejoice about the virtue you have been given over him by way of knowledge, faith (Eemaan) and guidance. Make your turning away from him part of thankfulness for the blessing of Allaah that He has given you and bestowed upon you."
